The concept of possessive power as it manifests in reproductions is the focus of criticism in this paper. The analysis utilizes both positive insights and illustrative mistakes from Beauvoir's account of maternity. An alternative notion of power is proposed to replace possessive power as proprietary control.

This essay explores ethical conflicts underlying the discourse of the policy debate about transracial adoption, focusing on the adoption of Black children by whites. Three underlying conflicts are analyzed, namely, the values of equality versus community, interracial community versus multiculturalism, individuality versus racial-ethnic community. The original essays in this volume, while written from diverse perspectives, share the common aim of building a constructive dialogue between two currents in philosophy that seem not readily allied: Wittgenstein, who urges us to bring our words back home to their ordinary uses, recognizing that it is our agreements in judgments and forms of life that ground intelligibility; and feminist theory, whose task is to articulate a radical critique of what we say, to disrupt precisely those taken-for-granted agreements in (...) judgments and forms of life. Wittgenstein and feminist theorists are alike, however, in being unwilling or unable to "make sense" in the terms of the traditions from which they come, needing to rely on other means—including telling stories about everyday life—to change our ideas of what sense is and of what it is to make it. For both, appeal to grounding is problematic, but the presumed groundedness of particular judgments remains an unavoidable feature of discourse and, as such, in need of understanding. For feminist theory, Wittgenstein suggests responses to the immobilizing tugs between modernist modes of theorizing and postmodern challenges to them. For Wittgenstein, feminist theory suggests responses to those who would turn him into the "normal" philosopher he dreaded becoming, one who offers perhaps unorthodox solutions to recognizable philosophical problems. In addition to an introductory essay by Naomi Scheman, the volume’s twenty chapters are grouped in sections titled "The Subject of Philosophy and the Philosophical Subject," "Wittgensteinian Feminist Philosophy: Contrasting Visions," "Drawing Boundaries: Categories and Kinds," "Being Human: Agents and Subjects," and "Feminism’s Allies: New Players, New Games." These essays give us ways of understanding Wittgenstein and feminist theory that make the alliance a mutually fruitful one, even as they bring to their readings of Wittgenstein an explicitly historical and political perspective that is, at best, implicit in his work. Ambitious higher-order theories of consciousness aim to account for conscious states when these are understood in terms of what-it-is-like-ness. This paper considers two arguments concerning this aim, and concludes that ambitious theories fail. The misrepresentation argument against HO theories aims to show that the possibility of radical misrepresentation—there being a HO state about a state the subject is not in—leads to a contradiction. In contrast, the awareness argument aims to bolster HO theories by showing that subjects are aware of all (...) their conscious states. Both arguments hinge on how we understand two related notions which are ubiquitous in discussions of consciousness: those of what-it-is-like-ness and there being something it is like for a subject to be in a mental state. This paper examines how HO theorists must understand the two crucial notions if they are to reject the misrepresentation argument but assert the awareness argument. It shows that HO theorists can and do adopt an understanding—the HO reading—which seems to give them what they want. But adopting the HO reading changes the two arguments. On this reading, the awareness argument tells us nothing about those states there is something it is like to be in, and so offers no support to ambitious HO theories. And to respond to the misrepresentation understood according to the HO reading is to simply ignore the argument presented, and so to give no response at all. As things stand, we should deny that HO theories can account for what-it-is-like-ness. (shrink)

In lieu of an abstract, here is a brief excerpt of the content:The Sources of MemoryJeffrey Andrew Barash“What does it mean to remember?” This question might seem commonplace when it is confined to the domain of events recalled in past individual experience; but even in this restricted sense, when memory recalls, for example, a first personal encounter with birth or with death, the singularity of the remembered image places the deeper possibilities of human understanding in relief. Such experiences punctuating everyday (...) life highlight the central place of memory as a source of human identity.With a few notable exceptions, such as Henri Bergson or Maurice Halb-wachs, this central role of memory was rarely a topic of interest in the theoretical orientations of our century. It played only a peripheral role in the different philosophical orientations and in the human sciences of this century until, very recently, new attempts have been made to comprehend the significance of memory, above all in the fields of intellectual history and philosophy. Without dealing exhaustively with the bibliography of works on memory, I will mention what seem to me to be the signs of a recent renewal of questioning in this area of interest to historians and philosophers alike. This will lead me to the specific problem I will address in the pages that follow.One of the chief sources of the historian’s recent interest in memory has been the historians’ conflict (Historikerstreit) of the 1980s concerning the interpretation of the German and European past since the rise to power of Nazism and in the aftermath of World War II. As the generations who lived through and—from a given perspective—remembered these events increasingly disappear, the question concerning their precise historical meaning has reemerged with a new urgency. In this vein, for example, as the relatively new periodical History and Memory: Studies in the Representation of the Past and the collection of essays Probing the Limits of Representation: Nazism and the “Final Solution,” edited by Saul Friedlander, amply attest, the relation of memory to historical narrative is as important as it is problematic: to the extent that eyewitness memory claims a status of objectivity beyond the fictional sphere of [End Page 707] the imagination, its role in informing historical narrative involves the very issue of objectivity itself. 1Independently of this query concerning the relation of memory and history in recent scholarship focusing on the twentieth century, a number of studies have attempted to place the idea of memory in historical perspective during premodern periods. In this regard, we may cite Janet Coleman’s recently published work, Ancient and Medieval Memories: Studies in the Reconstruction of the Past and Mary Carruthers’s treatment of the subject of memory in the medieval period in The Book of Memory: A Study of Memory in Medieval Culture. 2 A number of other recent works in the field of intellectual history have attempted to grapple with the intriguing problem of the historicity of the phenomenon of memory in the West. This idea of the historicity of memory has been inspired at least in part by Pierre Nora’s essay, “Between Memory and History,” which introduced the multi-volume series he directed, Les Lieux de mémoire. In this vein, Patrick H. Hutton’s History as an Art of Memory, Matt K. There is a long tradition of arguing that design and science are importantly different. One such argument is that the separation of science and design is an implication that can be drawn from the Simon–Kroes model of the nature of technical artifacts. This paper argues that the Simon–Kroes model does not imply a radical separation between science and design: if we accept the Simon–Kroes model of the nature of technical artifacts and their production, then we must also accept that all (...) the sciences also produce technical artifacts, and in importantly similar ways. Moreover, the placing of both science and design in a naturalist framework reinforces this conclusion and opens up new vistas for synergetic cross-disciplinary discussion of design and methodology. We examine the claim that design is demarcated from science by having wicked problems while science does not and argue that it is wrong. We examine each of the ten features Rittel and Weber hold to be characteristic of wicked problems and show that they derive from three general sources common to science and design: agent finitude, system complexity and problem normativity, and play analogous roles in each. This provides the basis for a common core cognitive process to design and (...) science. Underlying our arguments is a shift to a strategic problem-solving conception of method in both disciplines that opens up new opportunities for synergetic cross-disciplinary research and practice. This is a study of the effects of a number of background variables on ethical perceptions of Mexican and U.S. marketers. This research investigates how a marketer’s personal religiousness, relativism, and the ethical values influence in perceptions of the degree of ethical problems in hypothetical marketing scenarios. It also examines differences between Mexican and U.S. marketers on these variables. The results show significant differences in perception between the countries, and we discuss the implications of these differences for cross-cultural business activities.

The identity of lesbian-mother combines a marginalized identity with one of the most revered mainstream identities. With data collected through exploratory in-depth interviews from nine lesbian-mothers, the authors use symbolic interaction framework to explore the strategies that lesbian birth mothers and comothers employ to gain acceptance for their marginal-mainstream identities in their family networks. Respondents experienced varying levels of resistance from their social networks, with comothers being especially vulnerable due to their lack of both biological and legal substantiation. This book explores the logic and historical origins of a strange taboo that has haunted literary critics since the 1940s, keeping them from referring to the intentions of authors without apology. The taboo was enforced by a seminal article, "The Intentional Fallacy," and it deepened during the era of poststructuralist theory. Even now, when the vocabulary of "critique" that has dominated the literary field is under sweeping revision, the matter of authorial intention has yet to be reconsidered. This work explains (...) how "The Intentional Fallacy" confused different kinds of authorial intentions and how literary critics can benefit from a more up-to-date understanding of intentionality in language. The result is a challenging inventory of the resources of literary theory, including implied readers, poetic speakers, omniscient narrators, interpretive communities, linguistic indeterminacy, unconscious meaning, literary value, and the nature of literature itself. Ancient philosophers develop what has been called a compositional conception of justice. They treat the virtue of justice as conceptually anterior to a just social order and the moral standing of others. By reversing the order of priority, modern thought proposes structural conceptions of justice. However, Thomas Aquinas’s compositional account of justice may satisfy the demands of modern conceptions. He argues that there is a moral virtue called general or legal justice, which consists in responding to the demands of the (...) common good and a society’s laws. The article reconstructs Aquinas’s account of general justice and argues that he manages to resolve certain difficulties inherent in a compositional conception of justice. He can explain how a shared conception of the common good is reached, and how those who hold rival conceptions can be accommodated and expected to promote it. (shrink)

As the patient drew her last breaths, with her daughter at her bedside, and the curtain closed across the room, my resident, whom I will call Emma, talked me through what was happening. She explained that the patient's only hope for survival had been surgery, yet surgery would surely have killed her. Emma talked about the different ways different families approach withdrawing the level of care provided in the intensive care unit, allowing a loved one's death. She talked about how (...) hard it is to leave behind everything that happens in this job when she goes home. An intern arrived to make the declaration of death, and Emma encouraged me to go back into the patient's room for this. I placed my stethoscope on the patient's still chest, confirming what we already knew to be true. Death was palpable in that room, and my response was visceral. I did my best to leave the ICU calmly and then ran down five flights of stairs to the hospital chapel and sobbed. When I returned, Emma could see that I was shaken. “It's human,” she told me. In the afternoon, I felt the deep tiredness that I always feel after really crying. In that haze of emotion, I wasn't sure quite how to respond when Emma's next activity for us was to find a patient who needed an arterial blood gas. (shrink)

Justice is a divine attribute to which the sacred texts of the Abrahamic religions attest frequently and to which people attach great importance. However, it is the express subject of comparatively few contemporary studies. It has been argued that this is symptomatic of a long-standing trend in Christian theology, which has tended to conceive justice narrowly, as retributive. This paper makes the case that, mediaeval theologians, from Anselm to Aquinas, address the divine attribute of justice in depth and with philosophical (...) sophistication, viewing it primarily as God’s merciful and gracious distribution of merits and goods. It seeks to identify Aquinas’s contribution to the mediaeval analysis of this divine attribute and assess what he may have to contribute to current philosophy of religion. In particular, pointing to natural teleology, he offers more fully worked out metaphysical reasons for calling God just and considering all his works just. The existence of creatures can only be explained as an act of divine mercy, with the result that, since existence is the fundamental gift, all God’s works are merciful and just. (shrink)

There is a curious reluctance in many quarters to try to apply to the philosophical questions the ordinary person in the street is continually raising, the technique and results of recent logical and philosophical analysis. Ordinary persons like Uncle Tom and Aunt Mary persist in asking questions about the meaning of the Universe and the destiny of the individual. Yet, on the whole, the only answers that are offered come from those quarters that find themselves to-day increasingly out of tune (...) with the temper and idiom of the times and more and more out-manoeuvred by the “talkie” and the gossip columnist of the gutter press. This situation has certain unfortunate results, and consequently imposes on philosophical analysis a special function at the present time. (shrink)

While justifications are used frequently by young children in their everyday interactions, their use has not been examined to any great extent. This article examines the interactional phenomenon of justification used by young children as they manage social organization of their peer group in an early childhood classroom. The methodological approaches of conversation analysis and membership categorization analysis were used to analyse video-recorded and transcribed interactions of young children in a preparatory classroom in a primary school in Australia. The focus (...) is an episode that occurred within the play area of the classroom and involved a dispute of ownership relating to a small, wooden plank. Justifications were frequent occurrences as the young participants drew upon justificatory devices to support their stances. The justifications related to the concepts of ownership and were used by those engaged in the particular dispute to support their positions and provide reasons for their actions. Four types of justificatory responses using child-constructed rules are highlighted. They are: justification based on the rule of transferred ownership; the rule of first possession; rules associated with custodianship; and the rule of third-party verification. The justifications are practices that work to build and reinforce individual children's status within the group, which in turn contributes to the social order of the classroom. (shrink)

Finally, the author shares his story about how the members of a virtual community of scholars have facilitated his move from the periphery of the researching community into an authentic and valued practitioner-colleague with a personal theory of practice. The following paper, delivered as a lecture to the philosophy departments of a number of American universities in 1979, traces a parallel between Hegelian phenomenology and Freudian psychoanalysis. It stems from a project I have been working on for several years now entitled Erinnerungsversuch or "Essay in Remembrance. " In my studies of Freud and Hegel for that project I was struck by the importance of memory for their work, not only as a field of investigation but also as a (...) method of the investigation itself. Remembering and forgetting are the crucial events for both psychoanalysis and phenomenology, crucial yet maddeningly intertwined, so that while memory seems eminently subject to malfunction and even illness it remains the sole source of insight and cure. I therefore determined to extend the parallel as far as it would go-perhaps even farther-and the present paper is the result. I am of course aware that Hegel was not a psychotherapist, Freud not a systematic philosopher, and realize that if essays like this one may be excused at all it is only because they eventually grow silent and allow irreconcilable differences to reassert themselves. Yet there is a sense in which Hegel's creative recapitulation of the history of philosophy, seeking as it does to liberate philosophical thought from a crippling self-ignorance, amounts to therapy of spirit; and there is a sense in which Freudian therapy must shatter traditional prejudices in our thoughts about what the psyche or spirit is, by letting psychological phenomena show themselves as they are. I have tried to make the parallel as concrete as possible, shunning Freud's metapsychology and turning instead to one of his earliest accounts of psychoanalytic praxis, eschewing sweeping remarks about Hegel's "system" and concentrating on just a few pages from the Phenomenology. Readers trained in philosophy will know that a few pages of Hegel are bound to contain labyrinths. I hope that my psychologist-readers will overlook the oversimplified presentation of Freud-which results partly from the lecture form-and will forgive my unwillingness to make Hegel's thought seem less demanding than it is. Finally, if I am right, the Freud-Hegel parallel with respect to memory tells us a good deal not only about this fascinating faculty but also about that singular creature who is so ardent to remember and so prone to forget. Building on case studies of Wikipedia and the Daily Kos, this essay argues that different kinds of rules shape relations between members of the majority and of the minority in these communities in important and consequential ways.

In Gaudium et Spes and Dignitatis Humanae the Second Vatican Council not only presents the dignity of the human person as the parting point for its moral teaching but also grounds human dignity in natural teleology. Natural teleology is the view that the good of any thing corresponds to, and so can be discerned from, the ends to which it is directed by its nature, both that end which is proper to it and those ends that it has as part (...) of a wider order. As official Church teachings, these documents refrain from providing a philosophical justification of their account of human dignity. The existence of natural teleology, however, is generally contested in modern philosophy. For this reason, grounding human dignity in natural teleology constitutes a questionable approach to the issue. Of all major Catholic theologians, Thomas Aquinas is arguably the one who provides the most developed philosophical resources for articulating these views on natural teleology and its connection with human dignity. This paper examines and assesses the way in which he grounds human dignity in natural teleology. In his view, we see that human beings are the principle part of the universe and that the other parts of the universe are ordered towards the good of human beings. After surveying his general justification of how a thing is ordered to particular ends in virtue of its nature, the paper considers his explanation of how each part of the universe assumes further ends within the universe as a whole, and his main set of arguments on how we perceive human dignity against the backdrop of the natural teleology of the universe.
